Understand your options
Let’s talk about the law and marriage
As a couple, you need to decide how your assets and debts will be treated once you are married. The legal implications can sound complicated, but our team will explain each option clearly and help you understand which structure suits your circumstances.
In community of property
Your estates are combined into one joint estate, generally making you equal partners in the assets and liabilities. Certain loans and transactions may require your spouse’s consent. Because there is one joint estate, a spouse’s insolvency can affect the joint estate, and the death of either spouse can temporarily affect how shared assets are administered.
Out of community of property without accrual
Your assets and debts remain separate, giving each spouse independent control over their own estate. This can offer greater financial independence, although it may leave a non-earning spouse with less protection if the marriage ends. This arrangement requires an antenuptial contract to be signed before the marriage and registered in accordance with South African law.
Out of community of property with accrual
Your estates remain separate during the marriage and each spouse retains ownership and control of their own assets. If the marriage ends through death or divorce, the growth of each estate during the marriage is calculated and the spouse with the smaller growth may have a claim against the other estate. This arrangement also requires an antenuptial contract.
